Welcome to PlanMyPosts, a social media management platform that allows users to schedule, plan, and automate their social media presence. These Terms of Service (“Terms”) govern your use of our platform and services (“Service”). By registering as a member or using our Services, you agree to comply with and be bound by these Terms.
By completing the registration process or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms, including any additional guidelines, policies, and future modifications. If you do not agree to these Terms, you must not use our Services.
You must be at least 13 years old to use our Services. By registering for an account, you represent and warrant that you meet the eligibility requirements and that you have the legal capacity to enter into a binding agreement.
By registering as a PlanMyPosts member, you accept and agree to be bound by the terms of this End-User License Agreement:
PlanMyPosts grants you a limited, non-exclusive, non-transferable, revocable license to access and use our platform and Services, strictly in accordance with these Terms.
You agree that you will not:
1. Copy, modify, distribute, sell, lease, or sublicense any part of our Services or software.
2 Reverse engineer, decompile, or attempt to extract the source code of our software, except to the extent that such activity is expressly permitted by applicable law.
3. Circumvent or attempt to circumvent any security or access controls implemented on the platform.
PlanMyPosts may update the platform and software from time to time. These updates may include bug fixes, enhancements, new features, or new versions. You agree to receive such updates as part of your continued use of the Services.
PlanMyPosts integrates with various third-party APIs to provide its Services, including but not limited to:
1. Google API – For scheduling and posting on Google My Business.
2. Meta API (Facebook & Instagram) – For managing and automating posts on Facebook and Instagram.
3. Twitter API (X) – For scheduling and posting tweets.
4. LinkedIn API – For managing and automating posts on LinkedIn.
We use only official social media APIs provided through the respective Developer Platforms.
You acknowledge and agree that:
1. PlanMyPosts is not responsible for changes made by these platforms (e.g., API changes, policy updates, outages) that may affect the functionality of our Services.
2. We do not guarantee uninterrupted or permanent compatibility with any third-party API.
3. We do not provide refunds for issues or limitations that arise due to changes or restrictions imposed by third-party platforms.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
1. Notify us immediately at support@planmyposts.com of any unauthorized use or suspected breach of security.
2. Ensure that you log out from your account at the end of each session on shared devices.
You agree to use our Services in compliance with all applicable laws and regulations. You must not use our platform for any illegal or unauthorized purpose, including but not limited to:
1. Posting or distributing unlawful, harmful, defamatory, or infringing content.
2. Engaging in spamming, harassment, or abusive behavior.
3. Violating the terms of use of any social media platform connected to PlanMyPosts.
You are solely responsible for the content you create, upload, schedule, publish, or otherwise make available through our Services, including any text, images, videos, and links. You represent and warrant that:
1. You have all necessary rights, licenses, and permissions to use and share such content.
2. Your content does not infringe or violate any third-party rights, including intellectual property, privacy, or publicity rights.
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, store, and protect your personal information. By using our Services, you consent to the collection and use of information as described in the Privacy Policy.
PlanMyPosts may offer free and/or paid subscription plans. By selecting a paid subscription plan, you agree to pay the applicable fees and charges associated with that plan.
1. Subscription fees are billed in advance on a recurring basis (e.g., monthly or annually), depending on your selected plan.
2. Unless otherwise stated, all fees are non-refundable, except as required by applicable law.
You must provide a valid payment method to subscribe to paid Services. You authorize PlanMyPosts (and our payment processors) to charge your payment method for:
1. Subscription fees; and
2. Any applicable taxes, duties, or charges.
We reserve the right to modify subscription plans, features, or pricing at any time. Any changes will generally apply from your next billing cycle, and where required, we will provide notice in advance.
To the fullest extent permitted by law, PlanMyPosts, its affiliates, officers, directors, employees, and agents shall not be liable for any:
1. Indirect, incidental, special, consequential, or punitive damages;
2. Loss of profits or revenues (whether incurred directly or indirectly);
3. Loss of data, use, goodwill, or other intangible losses,
resulting from or related to:
Your use of or inability to use the Services.
Any unauthorized access to or use of our servers and/or any personal information stored therein.
Any interruption or cessation of transmission to or from the Services.
Any bugs, viruses, trojan horses, or other harmful code transmitted by any third party via the Services.
Any errors or omissions in any content, or any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Services.
In all cases, PlanMyPosts’ total aggregate liability arising out of or relating to the Services or these Terms shall be limited to the amount you have paid to PlanMyPosts for the Services in the twelve (12) months preceding the event giving rise to the claim, to the extent permitted by applicable law.
You agree to indemnify, defend, and hold harmless PlanMyPosts, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising out of or in any way connected with:
1. Your access to or use of the Services.
2. Your violation of these Terms.
3. Your violation of any third-party rights, including any intellectual property, privacy, or publicity rights.
4. Any claim that your content caused damage or harm to a third party.
PlanMyPosts reserves the right, in its sole discretion, to suspend or terminate your account and access to the Services at any time, with or without notice, for any reason, including but not limited to:
1. Breach of these Terms;
2. Suspected fraudulent, abusive, or illegal activity; or
3. Non-payment of applicable fees.
Upon termination, your right to use the Services will immediately cease. Certain provisions of these Terms, by their nature, will survive termination (including, but not limited to, ownership provisions, warranty disclaimers, indemnity, and limitations of liability).
These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law principles.
Any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively before the courts of competent jurisdiction located in Nairobi, Kenya, and you hereby consent to the personal jurisdiction and venue of such courts.
Before initiating formal legal proceedings, you agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services through good faith negotiations with PlanMyPosts.
If the dispute cannot be resolved amicably within a reasonable period, it may be referred to binding arbitration in Nairobi, Kenya, in accordance with the Arbitration Act of Kenya and the applicable rules of a recognized arbitration institution or an arbitrator mutually agreed by the parties. The arbitrator’s decision shall be final and binding and may be enforced in any court of competent jurisdiction.
We may update or modify these Terms from time to time. When we do, we will post the updated Terms on our website and, where appropriate, notify you by email or through the platform.
Your continued use of the Services after any such changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Services.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy and any other referenced documents or policies, constitute the entire agreement between you and PlanMyPosts regarding your use of the Services and supersede all prior or contemporaneous agreements, understandings, or communications, whether written or oral, relating to the subject matter herein.
